Partner and Affiliate Compliance Policy

The rules every MedStands partner and affiliate agrees to.

These rules are part of the Partner Agreement and the Affiliate Agreement, which incorporate this page by reference. If you promote MedStands, they bind you. Breaking them is grounds for suspension, and for withholding or reversing the fees on any sale generated by breaking them.

You market. You do not practice medicine.

You may tell people that a treatment exists and direct them to it. You may not diagnose, recommend a specific medication or dose for a specific person, promise an outcome, or say or imply that anyone is a good candidate for treatment. Whether a person is treated at all, and with what, is decided solely by an independent licensed provider. You cannot influence that decision, and you must never suggest that you can.

Never promise a result.

Do not state or imply guaranteed weight loss, a specific number of pounds, a timeframe, or that a treatment is safe, effective, or appropriate for everyone. Do not use before-and-after imagery you did not obtain lawfully with consent. Do not describe any medication as approved for a use it is not approved for.

Disclose that you are paid, every time.

Every post, message, page, and referral that carries a link or attribution code we issued you must clearly and conspicuously disclose that MedStands pays you, in the same medium, before or together with the endorsement. A platform "paid partnership" tag on its own is not enough. Describe it as a paid relationship. Do not call it a commission or a cut of what anyone spends, because it is neither: you are paid a flat amount per order, set in advance.

Do not pay people to get a prescription.

You may not offer or give any cash, discount, gift, rebate, free product, prize, or other inducement to any individual in exchange for seeking treatment, completing a consultation, or filling a prescription. You may not share your own compensation with a patient. This holds whether or not any federal or state health care program is involved.

Do not spam, and do not cold-contact patients.

All outreach must comply with the TCPA, CAN-SPAM, and state equivalents. No unsolicited calls or texts, no purchased consumer lists, no auto-dialers, no messaging anyone who has asked you to stop. Do not represent yourself as a clinician, a pharmacy, MedStands staff, or a government or insurance body.

Do not handle medication, and do not handle medical records.

You never take title to, store, transport, repackage, or dispense any medication. You should not receive patients’ medical information, and you must not ask for it, store it, or forward it. If a patient sends you clinical details anyway, do not keep them: direct the patient to the telehealth provider.

Stay inside the brand and inside the truth.

Use MedStands names, marks, and materials only as supplied and only as permitted. Do not bid on MedStands trademarks in paid search, impersonate MedStands, or build a site or profile that could be mistaken for one of ours. Do not alter our pricing, our claims, or our disclosures.

Tell us if you become ineligible.

You must notify MedStands within ten days if you or any of your principals are excluded, debarred, suspended, or otherwise made ineligible to participate in any federal or state health care program, or if a licensing or regulatory body takes action against you.

We enforce this.

MedStands may suspend or terminate any partner or affiliate who breaches these rules, and may withhold or reverse fees on any sale generated in breach of them. A suspended account’s codes stop attributing sales immediately.

If you are unsure whether something you want to say or do is allowed, ask us before you do it.
